State Representative Carlos Henriquez was sentenced to serve six months in Middlesex County House of Correction today after he was convicted of charges that he choked and punched an Arlington woman he was dating in July 2012.

A Cambridge District Court jury convicted Henriquez on two assault and battery charges, but acquitted Henriquez, a Dorchester Democrat, of a third assault and battery charge, one count of intimidation of a witness, and one count of larceny under $250.

The gold-standard "national statistics" status has been withdrawn from police recorded crime figures following repeated allegations that some of the quarterly published figures have been subject to "a degree of fiddling".

The UK Statistics Authority said it had taken the decision as a result of "accumulating evidence" that the underlying data on crimes recorded by the police may be unreliable.

It follows high-profile concerns over the integrity of the police crime figures raised by the Commons home affairs and public administration select committees. Her Majesty's chief inspector of constabulary, Tom Winsor, who is to report later this year on the issue, has said he expects to find "a degree of fiddling, some of it owing to dishonesty" among the 43 police forces in England and Wales. Winsor, however, has ruled out "institutional corruption" behind the inaccurate recording of crime by the police.

The allegations have included claims that the Metropolitan police have understated sexual offences by as much as 25%. MPs have heard allegations that fiddling techniques have included downgrading offences to less serious crimes or persuading victims not to make a complaint, while in some cases crimes were only recorded if they were solved. Other incidents were kept completely off the books if an offender could not be traced, they have been told.

The Lautenberg amendment prohibition on gun ownership applies to those convicted of misdemeanor domestic violence, and according to the New York Daily News, “Penn was also charged with felony domestic assault during his marriage to Madonna. He pleaded to a misdemeanor.”

Was that report in a major metropolitan newspaper accurate, and if so, is Penn a prohibited person, or have his legally-recognized gun rights been restored? How? Those would seem to be fair questions to explore.

“I did all of the talking on behalf of [the] DEA,” the DEA agent said, according to the court documents.

Even the two cases where poll workers turned away an investigator raise eyebrows. In the first case, a poll worker on Staten Island walked outside with the undercover investigator who had just been refused a ballot; the “voter” was advised to go to the polling place near where he used to live and “play dumb” in order to vote. In the second case, the investigator was stopped from voting only because the felon whose name he was using was the son of the election official at the polling place.

Be prepared for the usual suspects to wail and cry about a 'Warning Shots' bill

in Florida.  It's not, but they'll call it that.
In fact, neither SB 448 nor HB 89 have any mention of “warning shots” whatever.  They are, in fact, really merely efforts to fix an apparent glitch in Florida’s current self-defense law framework (hence their overwhelming support).

A close reading of Florida’s various self-defense statutes — including 776.012 Defense of Persons, 776.013 Home Protection, and 776.031 Defense of Others, and 776.032 Immunity — can result in the interpretation that they address only the actual use of force against another, and not the mere threat of the use of such force.

This has resulted in cases where a person who has merely threatened the use of force — e.g, displaying a defensive firearm to an attacker — finds himself with less legal justification than if he had taken the next step of actually using that force–e.g., shooting their attacker.  The seeming result would be to encourage the use of deadly force, even in circumstances where the use of such force could have been avoided.

There have now been numerous Florida cases in which a well-intentioned defender fired a “warning shot” in self-defense, found himself charged with aggravated assault, convicted, and sentenced to a mandatory 20-year-sentence.  In many of these cases, there was clearly no intent to cause anyone harm, and the defender sincerely believed the firing of the “warning shot” was the best means of reducing the risk of violence to all involved.  It seems bizarre in such cases that the defender could have potentially avoided  legal liability entirely if they had instead elected to shoot and kill their attacker rather than fire a “warning shot.”

The parallel SB 448/HB 89 bills seek to correct this situation by stepping through each of Florida’s self-defense statutes and replacing each use of “use of force” with the phrase “use or threatened use of force”.

If buying a car were like buying a handgun in Western Australia

Step 1.  Join a recognised car club.  Be a financial member for 6 months, do a safety training course and undergo (and pass) a safety test.

Step 2.  At the end of the six months, find a car that you want.  Ensure that it is a car which has a use at the club of which you are a member, and which:

a)      is no shorter than 3 metres,

b)      is no wider than 1.2 metres,

c)       has no silencer on the exhaust,

d)      has a fuel tank no larger than 10 litres,

e)      has a manual gear-box (no fully automatics allowed),

f)       has an engine capacity of less than 3.8 litres

g)      is not used by the police or military.

Step 3. Pay the vendor/dealer the full amount, and (for an additional fee) receive a copy of the serviceability certificate which contains the VIN number.  (Note, you can only purchase one car in the first six months).

Step 4. Apply to your car club for support of your purchase of the car, providing all details of the car, and specifying your intended use within the club’s activities.

Step 5. Ensure that your garage meets the requirements regarding construction material, and number of locks.  Fill in a Statutory Declaration to this fact and take supporting photographs.
Step 6. Ensure that you have acceptable separate storage for both the fuel and fuel tank.
Step 7.  Once you have passed the safety test, have the serviceability certificate and the club support letter, statutory declaration and photographs fill in the online form.  Detail your medical and mental health, genuine need for owning the car, intended use, and other miscellaneous information.

Step 8.  Print out the completed form.

Step 9.  Sign the form and take the signed form, supporting documentation and photographs along with 100 points of ID to a participating Post Office.

Step 10.  Hand form, supporting documentation, $246.30 and ID to the Post Office worker (after waiting in Post Office queue).  Wait while they take your photograph and lodge the form.

Step 11.  Wait approximately 6 – 12 weeks for the paperwork to be processed and a letter, your licence and your "extract of licence" card to be sent to you.

Step 12.  Take the licence to the seller (with the receipt) and collect your car.  Being sure to drive it directly home.

Remember cars can only be driven between your place and an approved club activity; your place and the police station and your place and mechanic.  

At all other times they must remain in the locked garage that no one else but you has access to, with the fuel tank, and fuel stored separately.

In fact, Gius found the opposite – that a proliferation of concealed carry permits can actually reduce incidents of gun crime.

Tried a new recipe today,

and it came out pretty well.  Daughter found it here.  I used a roast instead of brisket, and following her advice I used Simply Apple juice instead of cider, and on my own I left out the parsnips and threw in some new potatoes.  The meat's fork-tender, and tasty.  Which was a relief; it got done before I'd thought it would and I'd worried it was overdone.

I think next time I'll fiddle with spices a bit.  And you could probably use water and some suitable beer instead of juice/cider; all kinds of possibles come to mind.

The nearly 400-foot cutter, the Polar Star, is set to assist the Russian and Chinese ships because “there is sufficient concern that the vessels may not be able to free themselves from the ice,” the Coast Guard said in a statement.

In case you haven't followed this, they're stuck because they went to rescue a bunch of AGW researchers who went there to show 'all the ice is melting!' and got stuck.
