Clearly, current laws are too lenient in punishing such practices, which not only are unethical, but illegal. The Legislature should pass the bill.
Sounds good to me; prosecutors who knowingly violate the law and ethics SHOULD face personal consequences.
Now they need- ALL states need- to extend this to police who knowingly violate the law, or screw someone's life up through careless or deliberate actions(not bothering to make sure you have the right address, right person, use a SWAT team when they shouldn't and such).

Those who conduct such confiscations - no, let's call them 'thefts', because that's what they are - argue that what they're doing is legal, because they make sure to apply existing laws in new ways, or pass new laws to cover what they're doing.  Well, it may be legal, but that doesn't make it right.  It's like a federal officer conducting an unconstitutional search of someone's property.  He - and the federal 'establishment' - will argue that you have no right to resist him;  you can only sue after the fact to establish that the search was illegal, and obtain what restitution the courts will allow.  If you try to stop an illegal, unconstitutional search before it starts, the 'establishment' will arrest you, or even use lethal force against you for 'obstructing an officer of the law in the execution of his duty' - and then grant so-called 'qualified immunity' to those who've killed you, because they were 'doing their job', irrespective of whether or not their actions were legal.  It's just another example of how the 'establishment' will use the law to protect itself and its minions while screwing you.


The only way in which our cause can prevail is through positing a moral principle that applies to all—including those who choose to own no arms. This is the moral principle: every human being has a right to self-defense, and every human being has a sacred right to be trusted with arms unless he shows otherwise by his actions—a 'presumption of liberty, rather than a presumption that we are all evil and incompetent. 

Most of the Old World (with a few exceptions, such as Russia and Canada, which do have pro-active, self-defense oriented, gun rights movements) has no serious debate on the right to bear arms. A public consensus has emerged, in particular on the European continent, that civilian firearms are an evil to be mitigated, tolerated only for the purpose of sports. In some countries, gun owners now fear bringing up the issue of self-defense in public, for fear their gun license may be taken away (on allegations that they are owning a firearm for purposes other than sport).

This is a breach of fundamental property rights, dictated to a small country by foreign powers and it must make every bank depositor in Europe shiver. Although the representatives at the bailout press conference tried to present this as a one-off, they were not willing to rule out similar measures elsewhere - not that it would have mattered much as the trust is gone anyway. It is now difficult to expect any kind of limitation to what measures the Troika and EU might take when the crisis really starts to bite.
If you can do this once, you can do it again. if you can confiscate 10 percent of a bank customer's money, you can confiscate 25, 50 or even 100 percent. I now believe we will see worse as the panic increases, with politicians desperately trying to keep the EUR alive.
Depositors in other prospective bailout countries must be running scared - is it safe to keep money in an Italian, Spanish or Greek bank any more? I dont know, must be the answer. Is it prudent to take the risk? You decide. I fear this will lead to massive capital outflows from weak Eurozone countries, just about the last thing they need right now. Even from the EU as a whole, I suspect, as the banking union is in place in most countries already.
And when that trust is gone...

and in the chapter on April 19, it has a piece from an interview done with Captain Levi Preston of Danvers, at 91, on the events that day.

A SWAT team in upstate New York is being mocked as an example of the difference between military and police training after an officer was captured peering through a backwards sight on his combat rifle.
 ... 'It's disturbing to think that 1) none of his buddies corrected it, and 2) he's in a real-life situation with his optic on backwards, which means he's never fired that rifle with the optic on it, which means it isn't zeroed and he thought it was OK to show up to a gunfight with an unzeroed weapon,' wrote one Reddit user.
I do have to say he wasn't 'peering through' the sight; I (desperately hope) he'd have noticed the damn thing was on backwards if he'd ever bothered to look through it.

As I recall, it was a NYPD SWAT guy last caught with this, shortly after 9/11: standing guard with a M4(in requisite rolled-up sleeves to show the muscle) with a backward-mounted sight.  Maybe it's in the air up there?

I mean, come ON, who the hell would go out on a hot call with such a sight and not look through it to make sure the damn thing was on?

In the past, you could count on being able to pick up some useable rifle brass people had left behind.  That's been tapering off a lot; today the only brass cases I found were one berdan-primed 7.62x51, and a few .223.  If it was brass, it had been picked up.  ALL of it.

On the pistol side, there was some 9mm, .45acp, some other stuff, but not much; the exception was .22 cases.

Whether for reloading or selling, nobody's leaving anything behind anymore.

The Justice Department should hope that Justice Antonin Scalia — or his clerks — don’t catch wind of the IG report before Shelby v. Holder is decided. If he or they do, they will find a particularly interesting discussion regarding what Justice Scalia called “racial entitlements” in Section 5 of the Voting Rights Act.
The left has been apoplectic about Scalia’s observation. But yesterday’s DOJ inspector general’s report makes plain: many staff inside the Justice Department define Section 5 exactly as Scalia does: as a “racial entitlement.”
In the report, Assistant Attorney General Tom Perez — a possible Obama nominee to head the Department of Labor — makes clear that he doesn’t think Section 5 should ever be used to protect a white minority in covered jurisdictions.

Today the Department of Justice inspector general released a report on potential Labor secretary nominee Tom Perez’s DOJ Civil Rights Division. The timing of the release to coincide with his nomination was certainly accidental, because the report paints a damning portrait of the DOJ unit he managed.

– Threats were made to African American employees by other Justice Department staff. The threats were made because the black employees were willing to work on cases like the New Black Panther voter intimidation case and a case in Mississippi involving a black wrongdoer and a white victim. I testified about this disgusting hostility toward race-neutral enforcement of the law, and today’s report confirms it took place.
I wonder how much the major media will have to say about this?

• It would be illegal to lend a gun to a friend to take shooting. That would be a transfer. 5 years in federal prison
• Want to lend a gun to a friend to go hunting? It’s a 5 year in prison felony.
• No exception for state permits. All transfers must go through a dealer or 5 years in federal prison.
• UPDATE: Teaching someone to shoot on your own land is a felony, 5 years, if you hand them the gun. Not an exempted transfer.

 That's not all.  As the man says, We will go thermonuclear on anyone who votes for this crap, and that goes double for Republicans....This bill has nothing to do with ensuring people who are getting guns are law-abiding, and everything to do with getting backdoor registration, and creating a patchwork of rules and laws that will land anyone who uses guns, and isn’t a lawyer, in federal prison for a long time. Lots of otherwise law-abiding people are going to federal prison if this ends up passing, and I’m convinced that’s the whole idea.

Colorado Democrats: Aren't they just wonderful?

...A message delivered verbally to a representative of the Colorado Sheriff’s Association basically stated that the Senate Dems are very upset with the Colorado Sheriffs opposing the gun legislation proposed by the Senate Democrats. This message insinuated that this could negatively affect the salary bill which has been delayed and put off by the Democrats with the excuse that they would expect bipartisan support. President Barack Obama's administration and the gun control debate after the Connecticut school shooting have led to surging numbers of anti-government “patriot” groups, according to a civil rights group that tracks extremist groups.

The language used -- "anti-government 'patriot' groups -- is itself a lie. Only the wildest of anarchists are "anti-government." The Constitutional militia movement, of which I have been a leader for more than twenty years, is not "anti-government." We are pro-government, of the sort that the Founders would recognize -- small, of limited powers, reflecting the sentiments of the Declaration of Independence and the Bill of Rights that merely secure and codify natural, inalienable and God-given rights. In our view the present administration and its supporters inhabit a fundamentally alien world view to that of the Founders and ourselves -- they believe that the people serve the government whereas we believe that the government should serve the people. To the extent that the present administration continues to exhibit appetites for our liberty, property and lives we certainly oppose them, and organize with an eye to confront them if forced to, but we are NOT "anti-government." What we seek is not to coerce anyone to our point of view but merely to be left alone. Since the growing tyrannical appetites of the Obama administration (and others before it) as demonstrated by the so-called "Obamacare" law and the current rush to disarm the citizenry are evident for all to see, it is hardly an accident that people who they seek to victimize would object and organize themselves to resist.

The second part of the lie is to characterize a grab-bag of groups with contradictory aims and methods (even groups that consider each other as philosophical enemies) -- into one so-called movement. By conflating people and groups together as "extremists" with an alleged common purpose, SPLC gets to exaggerate, for the purposes of fund-raising, a threat which does not exist.

The Southern Poverty Law Center reported the rising numbers on Tuesday in its annual report on extremist groups.

Even a stopped clock is right twice a day. For the reasons set out above, there certainly is a rise in self-defense militias around the country, but the SPLC hasn't got a single clue as to how deep and broad that movement is because no one with any sense, after the experiences of the 1990s, is using the old paradigm of publicly-announced militia formations. Today's groups are small, quiet, made up of friends, relatives and neighbors on a local, even neighborhood, basis, and thus are immune to federal snitches, agents provocateur and even knowledge of the FBI or of SPLC. Actually, SPLC knows this but since it does not fit with their fund-raising strategy, they pretend an omniscience that simply does not exist.

The number of anti-government patriot groups, one category tracked by the center, rose dramatically over the past four years, from 149 groups in 2008 to 1,360 today, researchers reported. That was up about 7 percent from the 1,274 active in 2011.

This is a wild under-estimation.

The election and re-election of the nation's first black president and the rugged economy have fueled their growth, said Mark Potok, a senior fellow at the SPLC. “The anger, angst, frustration, fear surrounding the economy have very much poured fuel on this fire,” Potok said.

This fits with the collectivist sociology theories of SPLC and its intellectual brethren but how does it explain the growth of black self-defense militias? There is certainly concern that the present untenable government spending and printing of money will collapse into social chaos, but Obama being half-black has nothing to do with the growth of the armed citizenry. This is one more example of how present-day so-called progressives are reflexively obsessed themselves with race (and why they feel it necessary to conflate true racist terrorist groups like the Klan and NeoNazis with groups like ourselves who believe that the Constitution extends to everyone regardless of race, creed, color or religion). In their obsession with race, SPLC and others would put a 1930s Nazi gauleiter of Lower Swabia in the shade. It is their ultimate weapon, when out-argued, to cry racism and point fingers.

On gun control, the debate following the Newtown, Conn., mass murder of schoolchildren has led to “a kind of white-hot rage unleashed on both the radical right and also within more mainstream political circles,” he said.

"White-hot rage"? I don't see it. The administration has declared its appetite for more of our property and liberty. It is natural to oppose this grab but we cannot afford "white-hot rage." We're lining up to flout their new laws with carefully considered armed civil disobedience. If we were motivated into a "white hot rage" professional liars like Potok could not walk the streets of Montgomery in safety.

In the week following the Dec. 14 school shooting, the Federal Bureau of Investigation said it conducted more background checks for firearms sales and permits to carry than it has in any other one-week period since 1998.

Yes, certainly. And what do you conclude from this fact? Do the advocates of citizen disarmament believe that we are buying all these weapons and billions of rounds of ammunition merely to turn them in with the passage of the next law? We are not.

Some critics believe the SPLC is too broad in labeling hate and extremist groups, to the point of including legitimate political organizations that oppose illegal immigration, gun control, gay rights and other issues. The center's researchers say they use a variety of methods to track anti-government groups and compile their list from field reports, patriot publications, law enforcement sources and news reports. Potok said only active groups are included. “We are not just looking at one man and a computer,” he said.

The SPLC's symbiotic relationship with the militarized federal police agencies is a matter of record -- and it is a relationship which they profit from by numerous so-called "hate group seminars" that propagandize their world view to federal, state and local law enforcement. You may recall that SPLC defended the ATF at the time of the "Good O' Boys Roundup" scandal, when Alabama militia exposed their racist get-togethers which involved disgusting conduct such as the issuance of "nigger hunting licenses" and skits like one entitled "The Birth of the Black Race" which involved the "magical" appearance of a black baby doll from inside a watermelon. Disgusting stuff, but Morris Dee, in a story by Fox Butterfield in the New York Times, alleged that the Gadsden Minutemen's videotape was a forgery. It wasn't, as later proven by the FBI lab, but it WAS proof that SPLC is a willing handmaiden to government racists when it suits their agenda. Pretty ironic, huh?

The report states: “Generally, Patriot groups define themselves as opposed to the 'New World Order,' engage in groundless conspiracy theorizing, or advocate or adhere to extreme anti-government doctrines.”

"Groundless conspiracy theorizing" such as the Fast and Furious scandal, for example? Under the SPLC definition of "extreme anti-government doctrines," the Founders would have made their list.

The FBI defines military extremists as anti-government groups often organized into paramilitary groups that follow a military-style rank hierarchy and typically engage in wilderness, survival, or other paramilitary training, according to a September 2011 FBI report on domestic terrorism.

Yeah, well under that definition local search and rescue teams are "military extremists."

Along with the rise of extremist groups, Potok said there have been several home-grown terrorist plots against government buildings and leaders in recent months. He compared the climate to time leading up to the 1995 Oklahoma City bombing.

The propaganda of collectivists like SPLC is certainly the same, as is the government's militarized police actions, brought to fever pitch by the last three administrations and the so-called "war on terror." The only difference this time is that there will be no more free Wacos. SPLC and the administration know this and they are counting on SPLC's lying narrative to prepare the battlefield of a civil war they are apparently seeking in national and world opinion. The SPLC thus remains one of the most faithful lapdogs of federal tyranny.

The report cites several cases, including one centered on a Georgia Army base involving a group known as F.E.A.R. (Forever Enduring Always Ready). Federal prosecutors maintain that F.E.A.R. was led by active-duty soldiers at Ft. Stewart who also plotted bomb attacks in Savannah and aimed to poison apple crops in Washington state.

Probably a combination of liberal bigotry, pushing from the Obamites and Nanny Bloomberg and thinking "After Newtown we can push this through!" got it to this point.  Now they've got companies saying "Screw you, pass this and we're gone" and many, many local citizens pissed off to a high degree.  And reminding the clowns "That office does not belong to you, we can and will take it back."

And if anyone in Denver thinks the 'We'll move' is a bluff, well, other states have been actively telling Magpul "Hey, we'd LOVE to have you move here!"  And, as some other states are finding, other companies are getting the same invites.

Problem is, the politicians wanted to use these companies as punching bags but still keep them around(because politicians may hate the people and product but they LOVES them all those tax dollars and jobs), and thought "Why, no one would ever consider moving just because we call them 'murderers' and 'accessories to child killing' and such"; they're finding out they damn well can and will move.

I guarantee Schumer for one is trying desperately to think of a way to either tell certain companies they can't move, or some way to claim taxes from them after they move.

 "In its current form, it's a pretty flawed bill," said Greenlick, adding that "I don't think [the bill] is in play."
