is going to fly?
Miller said Bishop's failure to obtain tenure at the University of Alabama in Huntsville was likely a key to the shootings. Bishop, who has a doctorate from Harvard University and has taught at the University of Alabama in Huntsville since 2003, apparently was incensed that a lesser-known school rejected her for what amounted to a lifetime job.
"Obviously she was very distraught and concerned over that tenure," Miller said. "It insulted her and slapped her in the face, and it's probably tied in with the Harvard mentality. She brooded and brooded and brooded over it, and then, 'bingo.'"
Just think about that for a moment, and think about trying to sell it to a Alabama jury: "This HARVARD Doctorate didn't get tenure at a crappy Alabama university, and it pushed her over the edge! Don't you understand how stressful that was?"
Hell, a jury about anywhere(except the PROM*); I can imagine a juror slipping and asking "Are you shitting me? THAT'S your defense?"

Sounds more like a confession, than a defense.
If I was on that jury, and the morons pulled a defense like that, I'd demand that the defendant's legal team be hanged twenty minutes before the defendant.
Gerry N.
can the former DA be prosecuted for facilitating the crime?
That's not the defense; that's the explanation.
The defense was "[she] has severe mental problems that appear to be paranoid schizophrenia".
The "Bingo" there is not "Hey, they deserved it for making her mad", but "She finally went completely apeshit crazy".
Looking at her history, severe mental problems actually seem pretty plausible. It'll take the court psychiatrists' analysis to make or break the insane-enough-to-go-to-hospital-not-prison call, though.
Either mental problems of a classic kind, or a truly amazing level of entitlement disease.
