Remember I(and other people) wondered just how much Mann was going to like discovery? Seems he doesn't like it at ALL:

has failed for lack of prosecution and a counter claim has been filed
by Ball.

I always told you that Mann was walking into the trap of putting his scientific charlatanism on trial if he sued.

Massive counterclaims, in excess of $10 million, have just been filed
against climate scientist Michael Mann after lawyers affirmed that the
former golden boy of global warming alarmism had sensationally failed in
his exasperating three-year bid to sue skeptic Canadian climatologist,
Tim Ball. Door now wide open for criminal investigation into Climategate
conspiracy.
Buoyed by Dr Ball's successes, journalist and free-speech defender, Mark Steyn has promptly decided to likewise countersue Michael Mann for $10 million in response to a similar SLAPP suit
filed by the litigious professor from Penn. State University against
not just Steyn, but also the National Review, the Competitive Enterprise
Institute and Rand Simberg. Ball's countersuit against Mann seeks

Unfortunately, it seems there's been a little exaggeration in some of the reports about the Ball case lately.
According to Anthony Watts, the Ball case has not been dismissed, although it's true that Mann is dragging his feet on discovery.
Also, from the same post, there is little chance of Mann going bankrupt (unless a court actually does award Ball or Steyn millions in damages) over the case, as he's being subsidized by deep pocketed liberals through a "Legal Defense Fund".
