Well, this is major-level bullshit

Take your car in for an oil change.  Mechanic who can't drive a stick hits another mechanic and kills him.  Lawyer for the family of the deceased sues the car owner...

of course, that's where the $ is. Jose working in the shop has nada. the sharks will negotiate a split, take the insurance money, and go hit a round on the course. give the decedent's family a 40% cut if the sharks are feeling generous, sadly wishing the poor soul hadn't died - the injury and grief payout is so, so much more.....

Some time ago there was a traffic accident involving a scrap metal truck. The driver had not properly secured a load that included, among many other things, a large rusty machine. The load was ejected from the truck onto the roadway, caused a separate accident, people were injured, and lawsuits ensued.

The machine, that was only a small portion of the scrap metal load, was manufactured almost 80 years prior to the accident. It was used for some time in a factory for its intended purpose then scrapped. It sat unused for a few years, then someone purchased it from the scrap yard and used it as a boat mooring anchor for almost 20 years. It was then removed due to new regulations that prohibited the mooring of boats in that area of coastline and scrapped a second time. That's when the accident occurred.

The manufacturer of the machine was still in business and doing very well but was no longer owned by the same people and had not made a machine of any kind for decades.

Attorneys for a party injured in the accident brought suit against the current owners of the company and won. The company was forced out of business because the expense of defending the suit and the jury award.

Ain't the tort system grand?

I don't understand why the dealership can't be sued. Seems to me they are at fault for negligence, if nothing else. Can't let someone drive a car who does not know how.

According to the sources I have seen, Michigan law is such that neither the dealership or the offending employee can be sued. The dealership's insurance will cover the cost of the suit irregardless.
