ATF brought the new guidance out,

and I think the suppressor counter at work will be busy.

ATF has just posted the new rules of the road for cans, SBRs, SBSs and AOWs. You may have been impatient and wondered what was taking them so long, but in the federal regulatory agency world, getting this kind of thing out in just over 60 days is the equivalent of near-light speed.

Here are some of the highlights:

  • As of today, ATF is extending the ruling nationally, beyond the named plaintiffs and their members. In other words, law-abiding Americans no longer need a Form 1 to make a suppressor, SBR, SBS or AOW and they no longer need a Form 4 to transfer one. These items will be covered by the Gun Control Act, meaning 4473s and NICS background checks.
  • There are 15 states with laws on the books that require Form 1 and Form 4 processing by ATF for these items. ATF will continue to process these for people living in those states so that they can continue to make and own those items.
  • The serial number engraving requirement for home made suppressors, SBRs, SBSs or AOWs is now waived.
  • Keep in mind that the Gun Control Act and other provisions of the NFA are still in place. That means the GCA’s restrictions on interstate travel with SBRs and SBSs are still there. You’ll have to continue filing a Form 20 when you want to cross state lines with those.

There’s more, particularly for FFLs and manufacturers, but this is VERY good news for Americans across the country. You can read the Director’s guidance letter here.

But will the ATF delete all the records on suppressors, SBR's, SBSG's and transfers? Methinks not.

I don’t have to put serial numbers on my shoestrings now!

No wait, shoestrings are machine guns, I still need to put serial numbers on them.

Thank you for posting links straight to the horse's mouth, as it were.

As you probably know, many people have being saying this was happening. But until reading from the official source I was reluctant to move ahead.
Now happy days are here again.

On the old registrations, I don't know. We'll see what comes out on that.

That shoestring idiocy was a fine illustration of how messed-up that agency has been.

Yeah, I was waiting for the 'from the horse's mouth' before I'd believe/trust any of this.

Store I know was still doing Form 4s until they got said word. I think Monday they start doing those items on a standard 4473.

My issue with this is that the NFA Act is STILL a law "on the books". This decision is merely a bureaucratic decision to NOT require paperwork. At any time in the future the commie left could...and almost certainly will...regain administrative control and REIMPOSE all of the NFA requirements. THEN they could go after ANYONE who has any of these items without possessing the correct paperwork.

By their own writing, all that has to happen is for the tax to become any number other than zero - and its on. Their own wording states there will be no amnesty or grandfathering. My dog thinks its a truck and is afraid to get shot.

Your mileage may vary.
