Since he is retired, he's not out of reach. He is subject to recall for prosecution to face any charges. It's happened to numerous generals in the recent past. They take stars away and cut your retirement pay plus ending your clearance chances for contractor work.
Unfortunately, they don't drum people out of the military anymore.
