I'll make a suggestion: he's so busy trying to shove his socialized medicine scheme down our throats and trying to find a somewhat less-than-honest way to cut and run in Afghanistan and various other progressive bullcrap, that he doesn't want to deal with the storm of trying to shove a bunch of far-left judges through.
